Overfill of Material During Root Canal Blamed for Damage to Inferior Alveolar Nerve - $510,000 Settlement.
The plaintiff, age twenty-three, underwent a root canal performed by the defendant dentist. The plaintiff claimed that there was a gross overfill of toxic root canal material which penetrated the underlying inferior alveolar nerve canal and permanently damaged the inferior alveolar nerve.
The defendant claimed that the permanent damage was caused by a subsequent provider, who attempted to remove the overfill material about three weeks after the root canal.
According to a published account a $510,000 settlement was reached.
